1.THE TERMS AND CONIDTIONS GIVEN ARE A BINDING CONTRACT.

By registering to bid live and/or on the Internet, you agree to abide by all terms and conditions, and are acknowledging receipt of all explanations and information made available by Hiatt Auction LLC.

PLEASE NOTE: No shipping on aerosols or items containing fuel.

                          All Conex Containers require a licensed and insured rollback/Landoll for removal.

2. ONLINE PURCHASE

All local successful purchases UNDER $2,000 will pay at pick up with cash, MasterCard, Visa, or Discover in person with current legal photo ID required.

OUT OF AREA BIDDERS, INVOICES TOTALING OVER $2,000 AND REPRESENTATIVES PICKING UP:  Must pay with a Bank Wire Transfer due by 1:00 PM Central time the business day after the sale closes. Wire transfer instructions will be sent with invoice. Cash at pickup is also allowed.  If you live in the metro area pick up is required, we will not ship.

Failure to pick up or make payment according to instructions may result in a ban from future auctions. 

3. BUYER'S PREMIUM & BID CONTRACT

A 10% buyers premium will be added to all winning bids, resulting in the total purchase price. Your internet bids are a contract, and you are required to honor them. 

4. SALES TAX/USE TAX

State law requires that we collect sales tax on all transactions of items that are picked up locally or shipped to locations in Kansas. We do not ship with in the metro. If your business is tax exempt you will be required to fill out the Kansas Tax exemption form, which needs updated annually. Please see forms available for download on this site-also available on the Kansas DOR site. 

5. BID & BIDDER QUALIFICATION PROCESS.

All bidders must register with form of payment (credit or debit card) being used. INDFORMATION ON CARD MUST MATCH BIDDER INFORMATION. Bidders with a prior history of non-payment or violations of terms and conditions will be excluded from bidding.

We may contact all first-time bidders by phone to confirm information. All bids may be pending until we can speak to the registered bidder and confirm information.

Hiatt Auction LLC reserves the right to cancel any internet bid if the bidder refuses or fails to timely cooperate with the auction company's efforts to verify the bidder qualification to bid or if the bidder refuses to follow the terms & conditions in a professional and timely manner.

By registering to bid in this auction you authorize your confirmation of credit references, credit card companies and financial institutions to Hiatt Auction LLC. 

PLEASE NOTE: FIRST TIME BIDDERS AT HIATT AUCTION: Please register early for the auction to avoid any issues with bidding. 

6. INTERNET BIDDING

Do not bid until you have viewed all photos and descriptions.  We STRONGLY encourage on site previews prior to bidding. 

By placing a bid, the bidder agrees that they will pay for and pick up all items according to the terms and conditions. Failure to do so may result in not being able to bid at future auctions and monetary damages may accrue. You are responsible for any bids placed under your account. Do not bid if you cannot pay or pick up on time. 

This is an internet only auction, which means the highest bid online when the bidding closes on the item will be the winning bid. 

NOTE: Be sure to refresh your screen frequently so it does not "lag". This may result on missing a bid. 

Items are sold with no reserve. 

7. ITEMS SOLD "AS IS". PREVIEW IS ENCOURAGED.

All items are sold "as is, where is". 

Unless we state on the lot "tested, works" the item may not have been tested. There are no warranties expressed or implied on any items. We strongly encourage buyers to preview items or to contact us prior to bidding. Once you have placed a bid it cannot be removed. Buyer assumes all risks at the conclusion of the auction. All sales are final. No refunds given. Credit Card transactions cannot be reversed. 

Although mostly intact there are items that are used and might have pieces missing of which we are not aware. Listings included descriptions and photographs based on our general observation or information provided by the consignor. This is not mean to be substituted for or equate an inspection. It is the buyers sold responsibility to conduct an inspection or examination of items prior to placing any bids. 

In very rare cases some items may have to be removed at the seller's discretion. The auction may have to be rescheduled in extreme circumstances. 

8. SALE ORDER

Items are listed by lot number and sold in that order. 

9. INVOICING AND PAYMENT INFORMATION

Invoices will be emailed to all bidders at the conclusion of the auction. Check your spam folder if you do not receive one.

Invoices over $2,000, agent pick-ups or out of area shipments will include bank wire instructions in the body of the email. 

All other invoices require payment at pick up on Friday or Saturday.

A link to schedule a pickup appointment and details will also be included. 

We accept MasterCard, Visa, Discover, American Express, Cash or bank wires. WE DO NOT ACCEPT CASH APPS. 

If not picking up in person Cash or bank wire is required. We also will require an email with the individuals name and information to release items. Failure to pay by deadline of Saturday will result in an additional $10 admin fee. If not paid for and picked up by the following Wednesday bidder will be permanently banned from all future auctions. 

10. ASSET PICK UP AND REMOVAL

Please be courteous and schedule your pick up promptly in the time frame given. If you need to reschedule do so as soon as possible on the site to allow someone else to use your slot. 

Out staff will have items picked and ready to check out. At that time, please make sure all items are received. we cannot be responsible for items missed after you have left the premises. 

There will be an Appointment Scheduling link in the email sent with your invoice at the close of the sale. Click on that to see times available and instructions. 

If only picking up one item that does not require forklift assistance or a large number of items that may require more than 15 minutes to load, please call to help us schedule that. 

PICK UP TIMES: Friday 9AM-5PM Saturday 8AM-11AM.  

Special Instructions for Containers: 

Please call Dan at 913-963-1729 to schedule your container removal. We allow 7 days for container removal. A liscensed and Insured Rollback/Landoll is required. 

OUT OF AREA BUYERS: We ship all items under 50# via UPS or USPS no later than Wednesday.  We will call you prior to shipping with cost. A $20/50 pound shipment is added to the shipping cost for packaging and prep. You are also welcome to send a label. We will bill your account prior to shipping for all fees.

FREIGHT SHIPMENTS. We will palletize all items and send you dimensions and weights on each pallet. If you do not use a carrier, we recommend going to www.freightquote.com. You can compare prices and create a Bill of Lading on their site. Pick up for freight is Wednesday 1PM to 5PM. We will contact you to confirm and finalize details. Failure to make pick up can result in a rescheduling fee. 

11. NOT RESPONSIBLE FOR ACCIDENTS.

No children or animals are allowed on site. No smoking/vaping. Thank you for your cooperation. 

12. SERVICE OR EVENT INTERRUPTION

Hiatt Auction has no control on the unlikely event that the internet should go down during an auction. We will choose the best options available based on the circumstances.

Removal during scheduled pickup times by appointment Friday and Saturday. All winning bidders will receive an email with a link to schedule their pickup. If only picking up one item that does not require a forklift, the bidder can call 913-271-3045 and advise when they will be in during the pickup hours, Friday and Saturday. If picking up a large number of items, please call so we can coordinate a larger time slot. Pick up in person requires current legal photo ID.  If sending an agent cash at pick up or bank wire required and emailed authorization.

Shipping:

OUT OF AREA BUYERS: Out of area buyers are responsible for shipping on all items that can be shipped, or they can pick up. Shipping prep and transport for parcels available for additional service fee. Please note we will prep and ship parcels and freight by the following Wednesday. Shipments 50# or less will be shipped at the lowest cost between UPS and USPS. We will prep items for shipping and charge the buyer our prep fee and any shipping costs for first class priority or UPS Ground. More details below. If shipping or having an agent pick up items purchase payment must be made by wire transfer. All shipping arrangements must be made by email. Please contact us prior to scheduling freight pickups. If you need assistance getting a quote for shipping, we can supply the dims and weight. We recommend freightquote.com for obtaining rates.

PARCEL SHIPMENTS: $20 per 50# item/shipment. We will charge card on file to reimburse for postage. Must receive email authorizing shipment. We will get quotes for USPS or UPS shipping costs and debit before shipping. Anticipate delivery to US Post Office or UPS by Wednesday after the sale or sooner. Estimated shipping fee debited prior to shipping. Any additional fees will be added, if necessary, after that. Failure to make payment for shipping will result in storage fees for 5 days. After 5 days all items are considered abandoned and will be disposed of or resold.

 ***BE ADVISED!!!!**** *****FEES WILL BE ADDED IN CASE OF A MISSED FREIGHT PICK UP. $150 PER MISSED PICK UP. ESTES, FEDEX FREIGHT, UPS/TRANSFORCE, have never missed pickups. CENTRAL TRANSPORT has missed 6 out of 9 pickups****** Failure to remove an asset by the removal deadline noted in these terms and conditions ("Removal Default") will result in an additional administrative fee equal to 10% of the winning bid price (minimum $10.00 fee), plus storage fees of $10/day until the asset is removed from the auction site. 5 days after the removal deadline, Hiatt Auction LLC may also declare the asset abandoned resulting in additional costs and potential losses to the buyer. PAYMENT DEFAULT AND REMOVAL DEFAULT ARE NOT INCLUSIVE OF EACH OTHER AND MAY BE ADDED TOGETHER. IN ALL CASES OF BUYER DEFAULT OF THE AUCTION TERMS AND CONDITIONS, HIATT AUCTION LLC RESERVES THE RIGHT TO PURSUE ALL LEGAL REMEDIES.
