  2. ONLINE PURCHASE All LOCAL successful purchases UNDER $2000 invoiced will pay at pick up with cash, MasterCard, Visa or Discover. OUT OF AREA BIDDERS and Invoices totaling OVER $ 2000 must pay with a bank wire transfer or ACH transfer. due by 1:00 PM CDT the business day after the sale closes. Cash at pick up is also allowed.
  3. BUYER'S PREMIUM A 10% buyer's premium will be added to all winning bids, resulting in the total purchase price. Your Internet bids are a contract, and you are required to honor them.
  4. SALES TAX / USE TAX State law requires Hiatt Auction LLC to collect sales tax on all transactions picked up or shipped to locations in Kansas. If your purchase qualifies for tax exemption, you will be required to fill out the Kansas State form prior to bidding. See forms on our website or refer to the Kansas Dept. of Revenue website for more informaiton. Bidders must advise of exemption status and fill out KANSAS REQUIRED tax form at registration. Please contact us if you need assistance.
  5. BID AND BIDDER QUALIFICATION PROCESS. All bidders must register with form of payment (credit or debit card) being used. INFORMATION ON CARD MUST MATCH BIDDER INFORMATION. Bidders with prior history of nonpayment at auctions will be excluded from bidding. We contact all first time bidders by phone to confirm information. All bids will be pending until ntil we can speak to to the registered bidder and confirm information. Hiatt Auction reserves the right to cancel any Internet bid if the bidder refuses or fails to timely cooperate with the auction company's efforts to verify the bidder's qualification to bid or if the bidder refuses to follow the terms and conditions in a professional manner. By registering to bid in this auction, you authorize your confirmation of credit references, credit card companies and financial institutions to Hiatt Auction LLC.   6. INTERNET BIDDING: Do not bid unless you have reviewed all photos and information. An onsite preview is highly encouraged and available by appointment. By placing a bid the buyer agrees they will pay for and pick up items according to the terms and conditions. Failure to do so will result in not being able to bid at future auctions and monetary damages may insue. You are responsible for any bids placed under your account. If you cannot pick up in the sheduled time frame do not bid. This is an Internet-only auction, which means the highest bid online when the bidding closes on an item will be the winning bid for that item. Bidding for items will begin to close every 20 seconds. The items will close in the order listed on the website. This auction will feature our automatic extension system which will grant a (2) minute extension to the end of the auction of any item receiving a bid during the last three (2) minutes. The item will then close when three (2) minutes have elapsed without any bidding activity. All items are selling without reserve, and all Internet bids are treated as if they were given at a live auction. All bidders will be held accountable for their Internet bids. There are no bid retractions. Hiatt Auction reserves the right to cancel any Internet bid if the bidder refuses or fails to timely cooperate with the auction company's efforts to verify the bidder's qualification to bid.   7. ITEMS SOLD AS IS. PREVIEW IS ENCOURAGED. All assets, unless stated otherwise, are sold "as-is, where is". Unless we stated on the lot "Tested Works" the item may not have been tested. We strongly encourage buyers to preview items or to contact us for more information prior to bidding. Buyers assume all risks at the conclusion of the auction. All sales are final. No refunds given. Credit card transactions may not be reversed. Although mostly intact there are items that are used and might have pieces missing of which we are not aware. Listings include written descriptions, photographs. Equipment descriptions are based on our direct observation and information provided by the consignor. All information is intended to be as accurate as possible. Again-we recommend customers inspect prior to bidding. Information given regarding the items listed are not intended to be substitutions for inspection. An error or omission in the listing will not change the results of the bid.   8. SALE ORDER Items are listed by lot number and sold in that order.
  9. INVOICING AND PAYMENT INFORMATION Invoices will be emailed to winning bidders at the conclusion of the auction with the exceptions listed: Any invoice totals over $2,000 and for out of area buyers will need to be paid via wire or ACH funds transfer to our financial institution. It is a straightforward process which must be done no later than 3 PM CDT the next business day after the sale. PLEASE plan with your financial institution prior to bidding. We will email wire instructions at the end of the sale. All local invoice totals under $2,000: payment will be required at pickup. If not picked up by appointment time bidder will be charged for item and storage fees will accrue. If item not picked up in 5 days, it will be disposed of or resold at the auctioneer's discretion. Please do not bid if you may not pick up or have the means to pay. You will be banned from future auctions and risk being banned from other auction companies in the system. Do not allow anyone to bid online with your information. If they do you will be responsible for payment. Forms of payment accepted: MasterCard, Visa, American Express and Discover are accepted only for charges up to $2,000, and only after authorization in-person signatures are obtained from the cardholder. The credit card must be in the bidder's name and current address. Unsuccessful credit card transactions will result in immediate payment due. Please contact us prior to the sale if you would prefer a wire transfer to our bank. Please verify with your bank or credit card company if you need to raise your card limit prior to bidding. Failure to pay by the payment deadline noted in these terms and conditions will result in an additional administrative fee equal to 10% of the winning bid price (minimum $20.00 fee) per invoice. After the payment deadline, Hiatt Auction LLC may also declare the asset abandoned, resulting in additional costs and potential losses to the buyer. Defaulting customers will lose all bidding privileges with Hiatt Auction LLC. Hiatt Auction reserves the right to charge the credit card on file the total purchase price and a $30 delinquent payment fee will be added for invoices not paid within our terms.   10. ASSET REMOVAL PICKUPS AND SHIPPING. Please be courteous and schedule your appointment and pick up your items as soon as possible. Please keep your appointment time. Our staff will have your items picked and ready to check off with you. After receiving paid invoice buyer may click on link in invoice email to schedule pick up. You may also schedule by calling 913-271-3045 if you need assistance. PICK UP TIMES: FRIDAY 9 A.M.-5 PM SATURDAY 8 A.M.-Noon by appointment. There will be a link to schedule your appointment in the email containing your invoice and instructions. You may also call 913-271-3045 to get assistance to schedule your appointment. We repeat: FAILURE TO PICKUP by designated dates will result in daily storage of $10 PER LOT PER DAY up to 5 days. After that item will be considered abandoned and will be disposed of at auctioneer's discretion. Bidder will not be allowed to bid at future auctions. OUT OF AREA BUYERS: Out of area buyers are responsible for shipping on all items that can be shipped, or they can pick up. Shipping prep and transport for parcels available for additional service fee. Please note we will prep and ship parcels and freight by the following Wednesday. Shipments 50# or less will be shipped at the lowest cost between UPS and USPS. We will prep items for shipping and charge the buyer our prep fee and any shipping costs for first class priority or UPS Ground. More details below. If shipping or having an agent pick up items purchase payment must be made by wire transfer. All shipping arrangements must be made by email. Please contact us prior to scheduling freight pickups. If you need assistance getting a quote for shipping, after purchase please contact us via email. PARCEL SHIPMENTS: $20 per 50# item/shipment. We will charge card on file to reimburse for postage. Must receive email authorizing shipment. We will get quotes for USPS or UPS shipping costs and debit before shipping. Anticipate delivery to US Post Office or UPS by Wednesday after the sale or sooner. Estimated shipping fee debited prior to shipping. Any additional fees will be added, if necessary, after that. Failure to make payment for shipping will result in storage fees for 5 days. After 5 days all items are considered abandoned and will be disposed of or resold. ***BE ADVISED!!!!**** *****FEES WILL BE ADDED IN CASE OF A MISSED FREIGHT PICK UP. $150 PER MISSED PICK UP. ESTES, FEDEX FREIGHT, UPS/TRANSFORCE, have never missed pickups. CENTRAL TRANSPORT has missed 6 out of 9 pickups****** Failure to remove an asset by the removal deadline noted in these terms and conditions ("Removal Default") will result in an additional administrative fee equal to 10% of the winning bid price (minimum $10.00 fee), plus storage fees of $10/day until the asset is removed from the auction site. 5 days after the removal deadline, Hiatt Auction LLC may also declare the asset abandoned resulting in additional costs and potential losses to the buyer. PAYMENT DEFAULT AND REMOVAL DEFAULT ARE NOT INCLUSIVE OF EACH OTHER AND MAY BE ADDED TOGETHER. IN ALL CASES OF BUYER DEFAULT OF THE AUCTION TERMS AND CONDITIONS, HIATT AUCTION LLC RESERVES THE RIGHT TO PURSUE ALL LEGAL REMEDIES.
